NAR's Pending Home Sales Index indicates sales closed in April are likely to remain soft, with some drag possible into May as well. The Pending Home Sales Index, based on contracts signed in March, registered 104.3 - down 10.5 percent from March 2006 when it was 116.5. The March index is 4.9 percent below an upwardly revised February index of 109.7. The index is at its lowest point since a reading of 103.5 in March 2003, which coincidentally was the middle of the housing boom.

HOUSE PASSES NATIVE AMERICAN HOUSING BILL
The House recently passed the Native American Home Ownership Opportunity Act of 2007, H.R. 1676, an NAR-backed bill that will reauthorize a U.S. Department of Housing and Urban Development program that guarantees affordable loans for housing in Native American tribal lands.

Standard of Practice 11-1
When REALTORS® prepare opinions of real property value or price, other than in pursuit of a listing or to assist a potential purchaser in formulating a purchase offer, such opinions shall include the following:
- identification of the subject property
- date prepared
- defined value or price
- limiting conditions, including statements of purpose(s) and intended user(s)
- any present or contemplated interest, including the possibility of representing the seller/landlord or buyers/tenants
- basis for the opinion, including applicable market data
- if the opinion is not an appraisal, a statement to that effect (Amended 1/01)
Standard of Practice 11-2
The obligations of the Code of Ethics in respect of real estate disciplines other than appraisal shall be interpreted and applied in accordance with the standards of competence and practice which clients and the public reasonably require to protect their rights and interests considering the complexity of the transaction, the availability of expert assistance, and, where the REALTOR® is an agent or subagent, the obligations of a fiduciary. ON THE SAFE SIDE
Each week we will be covering a portion of the "MLS Rules and Regulations." To be on the SAFE SIDE, please review the rules each week to eliminate errors in the system which could lead to MLS violations and fines. These rules and regulations have been submitted and reviewed by NAR and are in full compliance with National Association policy.
VIOLATION OF SECTION 16 -- $500
Section 16.1 - Authorization:
Participants' consent for display of their active listings by other Participants pursuant to these rules and regulations is presumed unless a Participant affirmatively notifies the MLS that the Participant refuses to permit display (either on a blanket or on a listing-by-listing basis). If a Participant refuses on a blanket basis to permit the display of that Participant's listings, that Participant may not download or frame the aggregated MLS data of other Participants. Participant's consent to display of their listings by other Participants is required to have their listings transmitted by the MLS to authorized aggregators.
Section 16.2 - Participation:
Participation in IDX is available to all MLS Participants who are REALTORS® who are engaged in real estate brokerage and who consent to display of their listings by other Participants. This requirement can be met by maintaining an office or Internet presence from which Participants are available to represent real estate sellers or buyers (or both).
