FORMER SCAOR PRESIDENT WALT WAGAMON PASSES AWAY
Walt Wagamon, President of SCAOR in 1986, and REALTOR® of the Year winner, passed away at his home on Friday, June 22nd. Walt was a REALTOR® for over 30 years, and is survived by his wife Karen, who is also a REALTOR® with Coldwell Banker Residential Brokerage in Rehoboth Beach. Walt was an avid golfer and was very active in the Rehoboth Beach Yacht and Country Club. Additionally, he was a lifeguard for five years with the Rehoboth Beach patrol. He is also survived by his daughter Christina, of Salisbury, North Carolina. Our deep appreciation, our thoughts and prayers are with Walt's family.

We've been challenged to meet a goal by DAR. . . we are trailing behind Kent and New Castle.
What is RPAC? It is your Associations' fund to lobby important REALTOR® issues and issues that impact your business.
What "issues"? Tax ditches, Sussex County Land Use, DNREC regulations, DELDOT... just to mention a few... PLUS, bigger issues on the National Level.
What happens to your donation? 30% stays in Delaware and 70% goes to National. We ask for more if we have a need. This year, we asked for the funds to Survey Sussex Countians about land use and important local issues. The survey was $16,000. SCAOR paid $2,000, RPAC paid the rest.
Board member and long time RPAC contributor Lit Dryden said, "It has never been more true that if real estate is your profession, then politics must be your business. I've been contributing to RPAC for over thirty years. It is a unique, well-respected organization, working for the benefit of REALTORS® everywhere."
RPAC is not a business expense or a charitable contribution, according to the IRS, but it is the cost of doing effective business. You can afford to "take care of business"!

Article 14
If charged with unethical practice or asked to present evidence or to cooperate in any other way, in any professional standards proceeding or investigation, REALTORS® shall place all pertinent facts before the proper tribunals of the Member Board of affiliated institute, society, or council in which membership is held and shall take no action to disrupt or obstruct such processes.

Case #14-3: Submission of Pertinent Facts
Buyer A filed a complaint against REALTOR® B, the listing broker, involving a property purchased earlier by Buyer A.
REALTOR® B was notified of the complaint, directed to be present at a hearing, and requested to present to a Hearing Panel of the Board's Professional Standards Committee all pertinent facts relating to the transaction. REALTOR® B's response was a statement that he would refuse to submit any information in the matter to a Hearing Panel and would not attend the scheduled hearing, on the grounds that the complaint itself was not justified.
Explaining his position, REALTOR® B stated that his participation in the transaction was exclusively as the agent of the seller; that he had not been representing the buyer; and hence, could not be subject to a complaint by the buyer for simply transmitting information on behalf of the seller.
All of his statements concerning the property, REALTOR® B said, were based on information supplied to him by his client, the seller. Any error in this information, he contended, might well provide the basis for a lawsuit between the buyer and seller. As the agent of the seller, he felt that he was not answerable to the buyer for having done no more than transmit information provided to him by the seller.
REALTOR® B was advised by the Board that his reasoning was incorrect; that he was obligated by Article 14 to submit pertinent facts to a Hearing Panel of the Board's Professional Standards Committee and to participate in the hearing. REALTOR® B agreed to comply, and a hearing on the compliant was held.
Call Before Showing Requirement!
The MLS Rules and Regulations are being updated to impose a fine if it is reported that a property was shown using lockbox access and the showing agent did not call the listing office before showing.

ON THE SAFE SIDE
Each week we will be covering a portion of the "MLS Rules and Regulations." To be on the SAFE SIDE, please review the rules each week to eliminate errors in the system which could lead to MLS violations and fines. These rules and regulations have been submitted and reviewed by NAR and are in full compliance with National Association policy.
HEARING OUTCOME
The MLS Hearing panel will submit their decision in writing, signed by all panel members to the SCAOR staff and the Participant who requested the Hearing, within 10 days. If a majority of the MLS panel finds that a rule or regulation has been violated, the fine will stand. If a majority of the MLS panel finds that the Participant's appeal prevails on its merits, the panel will revoke the disputed fine.

This week's "Affiliate of the Week" is Cynthia Karnai with the Delaware State Housing Authority in Wilmington. She is a member with the New Castle Board of REALTORS® and the Delaware Federation of Housing Counselors. Cynthia has a B.A. and M.A. degree from the University of Delaware. She is currently pursuing an MBA from Goldey Beacom College.
The Delaware State Housing Authority provides low-rate mortgages for first-time home buyers, as well as down payment and settlement assistance resources. Sussex County homebuyers may have purchase prices up to $292,500 and household income up to $77,625. Other eligibility criteria apply.
In addition to its role as the State's Housing Finance Agency, DSHA is unique in that it also serves as a Public Housing Authority and acts as a Community Development and Planning Agency. As a Public Housing Authority, DSHA receives funding from HUD to build, own and operate public housing in Kent and Sussex counties.
