SHARON PALMER

Sharon has been an agent with Coldwell Banker Resort Realty since 1987, starting in the Sales division and then transferring to the Rental Department in 1990, were she currently serves as Manager.

Sharon has served on many committees for the Sussex County Board of REALTORS® including Rental Affairs, Grievance, and Professional Standards. She is a committee member of the International Student Outreach Program in Rehoboth and has served as a volunteer for Delaware Hospice Casino Night, Rehoboth Independent Film Festival, Rehoboth Jazz Festival, and Children & Families First Walk/Run. She was given the Outstanding Rental Service Award in 2005 and was a ROTY candidate in 2006. Sharon resides in Lewes.

This is only an approved proposed Slate of Officers — not the elected leadership for the upcoming year. Individual ballots will be sent via email in September. Balloting for 2008 will be using our secure on-line service.

According to our By-Laws, under Article XI Section 4, Election of Officers and Directors, it states:

"The Board approved Slate of Officers shall be noticed to each member eligible to vote no later than August 10. Additional candidates for the offices and directorships to be filled may be placed in nomination by a petition signed by at least five percent (5%) of the SCAOR membership in good standing. The petition shall be filed with the Executive Vice President by noon on the 31st day of August, which is the last working day of the month. The Executive Vice President shall verify that signatures are authentic and that the petitioners are members in good standing of the Sussex County Association of REALTORS® and they meet SCAOR voting eligibility requirements, and will place any additional candidates on the ballot."

Please print and post in your offices, the attached proposed Slate of Officers and related by-laws allowing additional candidates for petitions filed by noon, August 31st.

SCAOR will hold two classes (but one's already gone) on the new Statutory Agency Law. This is a three (3) credit hour Legislative Update course for the current licensing period. Both classes will be held at Possum Point Players in Georgetown. Due to the high demand for this training, please register as soon as possible. Each class holds 175, but seats are selling fast. Additional classes will not be held until September or later.

ICE YOUR PHONE FOR SAFETY

All cell phones feature one-button speed dialing, linked to your address book. Set one button to speed dial 911. It's also a good idea to "ICE" your cell phone. ICE stands for "In Case of Emergency." Assign one or two speed dial numbers to ICE, followed by the name of the person or place you want contacted, such as ICE Home or ICE Work, or the preferred order of contacts, such as ICE 1, ICE 2, etc. If you are incapacitated, emergency responders can use ICE to contact the proper people for you.

ON THE SAFE SIDE

To be on the SAFE SIDE, please review the MLS Rules and Regulations to eliminate errors in the system that could lead to MLS violations and fines. To print out a copy of the rules, simply click on "standard forms" in InnoVia. Click on "2005 MLS fine system-rev07-04.pdf" for a complete list of MLS violations and fines associated with them. For the latest version of the MLS Rules and Regulations, click on "2007 MLS Rules.pdf." These rules and regulations have been submitted and reviewed by NAR and are in full compliance with National Association policy.

 

Radon Disclosure

Delaware law now requires that the seller of any interest in residential real property, including a dwelling, disclose information about radon hazards to the buyer. The buyer must acknowledge the seller's disclosure.

The Delaware Department of Health and Social Services has provided us with a "RADON Rights, Risks and Remedy for the Home Buyer" document that must be presented to the seller, along with a Radon Disclosure, at time of property listing. Both documents will also become available at the Delaware Real Estate Commission website under "forms."

A buyer must be provided with the seller's disclosure and the "RADON Rights, Risks and Remedy for the Home Buyer" document. The Radon Disclosure, signed by both the seller and the buyer, is now a state required document that should be included as a part of the Agreement of Sale.

Website Compliance -
If you display listings of other firms on your website,
be sure to read this notice.

SCAOR has implemented new agreements and requirements that pertain to any Member or Participant that displays the listings of other firms on their websites. We refer to this exchange as Internet Data Exchange (IDX). The data for this exchange is supplied by our MLS provider for use in website display.

As the Participant, you should make sure that each agent within your firm that displays the listings of other firms has entered into these new agreements. As the Participant, you are accountable for the compliance of your agents through your acceptance of their IDX agreement.

If you did not complete our prior IDX agreements and your Internet service provider is supplying you with IDX, you need to complete these new agreements prior to August 15, 2007. Subsequent to that date, you will be subject to a compliance fine.

If you have previously executed IDX agreements, we ask that you now complete these new agreements and forward them to SCAOR at your earliest convenience.

ETHICALLY SPEAKING...

Article 16
REALTORS® shall not engage in any practice or take any action inconsistent with exclusive representation or exclusive brokerage relationship agreements that other REALTORS® have with clients. (Amended 1/04)

Standard of Practice 16-5
REALTORS® shall not solicit buyer/tenant agreements from buyers/tenants who are subject to exclusive buyer/tenant agreements. However, if asked by a REALTOR®, the broker refuses to disclose the expiration date of the exclusive buyer/tenant agreement, the REALTOR® may contact the buyer/tenant to secure such information and may discuss the terms upon which the REALTOR® might enter into a future buyer/tenant agreement or, alternatively, may enter into a buyer/tenant agreement to become effective upon the expiration of any existing exclusive buyer/tenant agreement. (Adopted 1/94, Amended 1/98)

Standard of Practice 16-6
When REALTORS® are contacted by the client of another REALTOR® regarding the creation of an exclusive relationship to provide the same type of service, and REALTORS® have not directly or indirectly initiated such discussions, they may discuss the terms upon which they might enter into a future agreement or, alternatively, may enter into an agreement which becomes effective upon expiration of any existing exclusive agreement. (Amended 1/98)
