IT'S HERE - NEW STATEWIDE AGREEMENT OF SALE

Attached is the long awaited, Statewide Sales Agreement for Delaware. This represents numerous hours of intense scrutiny and legal review by some of the most respected minds in the real estate industry from all 3 counties in our State.

The new sales agreement incorporates the new Agency Law in to the boiler plate to coincide with the recently released Consumer Information handout from the Delaware Real Estate Commission.

Brokers and Agents: Please replace any former draft copies you may have with this final "Agreement of Sale for Delaware Residential Property" last updated on September 4, 2007.

BILL LUCKS

Bill has been a licensed REALTOR® since 1980, starting in Bethany Beach and earning the designations of GRI and ABR. Early in his career Bill worked in spec homes and new developments, moving in the market to concentrate only in the commercial real estate arena, which he does full time today with his new firm, Commercial Sales Group.

Prior to real estate Bill was a banker, having organized and opened what is now Delaware National Bank. Devoting full time to his profession, Bill has always been keen on giving back to the real estate community and as a result, is currently Treasurer for the Delaware Association of REALTORS®, has served as a Director of DAR and chairs the Public Policy Committee. At SCAOR, Bill has served on the MLS committee for many years, teaches the MLS class, has been a Director of SCAOR previously, and serves as Chairman of the Building Committee. In addition, Bill teaches Ethics and Agent Core Class. At NAR, Bill serves on the Commercial Alliance Committee, has attended the mid-year conventions in Washington, D.C., and the annual convention last year in New Orleans. Bill was named REALTOR® of the Year for 2006.

Outside of real estate, Bill lives in Lewes, enjoys his extended family, works hard in his garden, swims laps and enjoys "Billie", a rescued Gordon Setter.

 

We want you!! SCAOR is asking our membership to consider joining a committee in 2008. As this year ends, we begin preparation for years to come. The Board of Directors has approved an exciting Strategic Plan to lead us forward. But, we need members to take a step and help us achieve our goals. Some committees have special requirements; however, many committees require desire and commitment. Please review our list of committees and determine your interest, your desire, and let your Association know.

Wishing you took Spanish so you could broaden your sales ability? Join SCAOR for a 7 week, 15 credit course in beginning Spanish. Classes begin October 24, and run each Wednesday evening except for the Wednesday before Thanksgiving, from 5:30 - 7:30 pm at the SCAOR office through December 5. On Thanksgiving week class will be held Monday, November 19 from 5:30 - 7:30 pm.

ON THE SAFE SIDE

To be on the SAFE SIDE, please review the MLS Rules and Regulations to eliminate errors in the system that could lead to MLS violations and fines. To print out a copy of the rules, simply click on "standard forms" in InnoVia. Click on "2005 MLS fine system-rev07-04.pdf" for a complete list of MLS violations and fines associated with them. For the latest version of the MLS Rules and Regulations, click on "2007 MLS Rules.pdf." These rules and regulations have been submitted and reviewed by NAR and are in full compliance with National Association policy.

MLS ORIENTATION

Any applicant for MLS Participation and any licensee affiliated with an MLS Participant who has access to and use of MLS generated information shall complete an orientation program of no more than three (3) classroom hours devoted to the MLS rules and regulations and computer training related to MLS information entry and retrieval and the operation of the MLS within sixty (60) days after access has been provided. Failure to attend orientation will result in denied access to the MLS until such training has been completed.

 

Lockbox Shortage

Due to the very high number of listings, and the lockbox shortage, please remove lockboxes from pending listings, and use only on active listings. This will help with the lockbox inventory shortage. Thank you.


 

SAFETY TIPS FOR ON THE JOB

  • Know where you are going - so you won't get lost in unfamiliar neighborhoods.

  • Keep your phone on and with you - with programmed 9-1-1 key.

  • Share your location - let someone at the office know where you are, who you are with, and how long you expect to be.

  • Set a call schedule and code - arrange an interval when you should be contacted when meeting with clients. Set up a coded message or sentence to indicate if you feel threatened, or need help.

  • Trust your instincts - if a situation feels dangerous, do not continue until you are comfortable.

 

ETHICALLY SPEAKING...

Article 16
REALTORS® shall not engage in any practice or take any action inconsistent with exclusive representation or exclusive brokerage relationship agreements that other REALTORS® have with clients. (Amended 1/04)

Standard of Practice 16-11
On unlisted property, REALTORS® acting as buyer/tenant representative or brokers shall disclose that relationship to the seller/landlord at first contact for that buyer/tenant and shall provide written confirmation of such disclosure to the seller/landlord not later than execution of any purchase or lease agreement. (Amended 1/04)

Standard of Practice 16-12
REALTORS®, acting as representatives or brokers of sellers/landlords or as subagents of listing brokers, shall disclose that relationship to buyers/tenants as soon as practicable and shall provide written confirmation of such disclosure to buyers/tenants not later than execution of any purchase or lease agreement. (Amended 1/04)
