BEGINNING SPANISH FOR REALTORS®
Wishing you took Spanish so you could broaden your sales ability? Join SCAOR for a 7 week, 15 credit course in beginning Spanish. Classes begin October 24, and run each Wednesday evening except for the Wednesday before Thanksgiving, from 5:30 - 7:30 pm at the SCAOR office through December 5.

On Thanksgiving week class will be held Monday, November 19 from 5:30 - 7:30 pm.
YOU MUST ATTEND ALL SEVEN CLASSES IN FULL TO RECEIVE COURSE CREDIT.

DELAWARE REALTOR® OF THE YEAR

Congratulations to Rick Allamong,
Delaware REALTOR® of the Year for 2007.

The Delaware Association of REALTORS® is pleased to announce that the 2007 REALTOR® Of The Year is Rick Allamong, Broker and Branch Vice President for Coldwell Banker Residential Brokerage, Bethany Beach, DE. Rick holds the CRS, GRI and ABR Designations from the National Association of REALTORS®.

Allamong was the 2006 President of the Sussex County Association of REALTORS®. Before serving as Board President, Rick volunteered his time to serve on the Board of Directors and is the current MLS Chair. He received the SCAOR President's Award in 2004. He has also given of his time to serve on numerous committees for the Delaware Association of REALTORS® and the National Association of REALTORS®. He is an active continuing education instructor for our industry and he drafts articles on industry topics for community newspapers. Rick is also a current member of the Delaware Real Estate Commission and a member of the Bethany-Fenwick Chamber of Commerce.

Rick is an active volunteer in his community supporting the American Red Cross and American Cancer Society Relay for Life as well as participating in the Coldwell Banker Cares foundation.

Rick believes that professionalism and maintaining professional integrity are paramount in operating a successful brokerage operation and often assists other Brokers with questions and concerns.

Congratulations to Rick Allamong. He will represent Delaware at the National Association of REALTORS® annual conference in Las Vegas in November.

 

Join SCAOR, elected officials and local agencies at Possum Point Players on November 6 at 2 pm for an informational discussion on the housing needs in Sussex County. Learn about assistance for first time homebuyers, foreclosures in the current market, and predatory lending. If you are interested in attending, there is no cost, but please register.

We are also seeking volunteers...

Following the discussion, there will be an Open House for first time home buyers at 5:30 pm, with a special emphasis on the immigrant population. If you are interested in volunteering for the Open House, sign up by clicking here.

The new sales agreement incorporates the new Agency Law in to the boiler plate to coincide with the recently released Consumer Information Statement from the Delaware Real Estate Commission.

The SCAOR Annual RCS Auction is scheduled for Thursday, October 18 at the Baycenter in Dewey Beach. The silent auction will be held downstairs (Crabber's Cove) from 5:30 - 6:30 pm. The live auction will begin around 7 pm in the Baycenter. Cost is $35 per person which includes admission, hors d'oeuvres and one free drink; walk-ins will be charged an additional $5. Proper Use of the Word "REALTOR®"

I've been noticing quite a few violations of the use of the word "REALTOR®" lately. To help refresh our memories, I thought I would share an article, which is written by Laurie Janik, NAR's legal counsel on the proper use of the word, "REALTOR®."

ON THE SAFE SIDE

To be on the SAFE SIDE, please review the MLS Rules and Regulations to eliminate errors in the system that could lead to MLS violations and fines. To print out a copy of the rules, simply click on "standard forms" in InnoVia. Click on "2005 MLS fine system-rev07-04.pdf" for a complete list of MLS violations and fines associated with them. For the latest version of the MLS Rules and Regulations, click on "2007 MLS Rules.pdf." These rules and regulations have been submitted and reviewed by NAR and are in full compliance with National Association policy.

HOW IT WORKS

Alleged violations of the MLS Rules and Regulations must be made in writing and accompanied by a completed MLS Violation report and may be initiated by:

  1. MLS Participant and/or subscriber, as defined in the MLS Rules and Regulations;
  2. Licensed and unlicensed administrative and clerical staff affiliated with the MLS Participant;
  3. Staff of SCAOR or of boards/associations of REALTORS® that purchase services from SCAOR;
  4. Members of the public.

In order for a Participant to be fined, a completed MLS Violation Report and a copy of any substantiating documents must accompany the Violation report. Anonymous faxes will not constitute a formal complaint. These forms may be mailed, faxed or delivered to the SCAOR office. The staff will keep all correspondence confidential. MLS staff will check the database to confirm the violation. If a violation occurs, it will fall into one of the following categories:

  1. Minor violations;
  2. Subsequent Minor Violations;
  3. Failure to correct a listing within 48 hours of a Listing Complaint Fine Notification, regarding Minor Violations (Section IV);
  4. Serious Violations;
  5. Prohibited activities;
  6. Unauthorized dissemination of system access password;
  7. Failure to correct a listing within 48 hours of a Listing Complaint & Fine Notification, regarding Sections VI, VII & VIII;
  8. Failure to pay a fine;
  9. Violations for Section 16 (IDX) of the MLS rules and regulations.

 

ETHICALLY SPEAKING...

Article 16
REALTORS® shall not engage in any practice or take any action inconsistent with exclusive representation or exclusive brokerage relationship agreements that other REALTORS® have with clients. (Amended 1/04)

Standard of Practice 16-15
In cooperative transactions REALTORS® shall compensate cooperating REALTORS® (principal brokers) and shall not compensate nor offer to compensate, directly or indirectly, any of the sales licensees employed by or affiliated with other REALTORS® without the prior express knowledge and consent of the cooperating broker.

Standard of Practice 16-16
REALTORS®, acting as subagents or buyer/tenant representatives or brokers, shall not use the terms of an offer to purchase/lease to attempt to modify the listing broker's offer of compensation to subagents or buyer/tenant representatives or brokers nor make the submission of an executed offer to purchase/lease contingent on the listing broker's agreement to modify the offer of compensation.

 

Watchdog SUSSEX COUNTY MEETINGS ON PROPOSED COMP LAND USE PLAN
Next Week!

Sussex County meeting on the proposed (Comprehensive Land Use Plan) are scheduled for Tuesday, September 25, 6:30 - 8:30 p.m. at the Rehoboth Beach Convention Center on Rehoboth Avenue, Rehoboth Beach, and Wednesday, September 26, 6:30 - 8:30 p.m. at the Laurel Fire Hall, 10th Street, Laurel. These meetings follow a series of public hearings on the update in January and February.
