STATE RESIDENTIAL AGREEMENT OF SALE

The Sussex County Association of REALTORS® Board of Directors has officially approved the New State Agreement, and as such, the obsolete agreement has been deleted from InnoVia. The revised form is the ONLY SCAOR endorsed agreement. An editable version will arrive shortly.

THE SCAOR ANNUAL RCS AUCTION IS THURSDAY, OCTOBER 18 . . .

. . . at the Baycenter in Dewey Beach. The silent auction will be held downstairs (Crabber's Cove) from 5:30 - 6:30 p.m. The live auction will begin around 7 p.m. in the Baycenter. Cost is $35 per person which includes admission, hors d'oeuvres and one free drink; walk-ins will be charged an additional $5.

Join SCAOR, elected officials and local agencies at Possum Point Players on November 6 from 2 - 4 pm for an informational discussion on the housing needs in Sussex County. At this Housing Summit, you can learn about assistance for first time homebuyers, foreclosures in the current market, and predatory lending.

Please register to attend this FREE, informative event. A separate evening presentation is being provided for first time homebuyers, with special emphasis on the immigrant population. If you are interested in volunteering for the evening presentation, please sign up.

 

Due to recently received questions and concerns regarding Lead Disclosure, please make careful note of the following information:

Federal Law requires that individuals receive certain information before renting or buying a pre-1978 housing as outlined in the Residential Lead-Based Paint Disclosure program. The form is titled "Disclosure of Information on Lead-Based Paint and/or Lead-Based Paint Hazards."

Federal Laws require all home sales to disclose the age of the home on the Lead Based Paint Disclosure. If the seller discloses the age of the home is unknown, the Disclosure of Information on Lead-Based Paint and/or Lead-Based Paint Hazards is required.

In addition, the Delaware Real Estate Commission requires the use of the Sellers Disclosure of Real Property Condition Report or New Construction Sellers Disclosure of Real Property Condition Report.

The Radon Disclosure form has been revised to remove the word "hazard." The intent of the disclosure is that the seller would disclose the presence of any know radon vs. any know radon "hazards." Please ensure your office is using the correct form:

ON THE SAFE SIDE

To be on the SAFE SIDE, please review the MLS Rules and Regulations to eliminate errors in the system that could lead to MLS violations and fines. To print out a copy of the rules, simply click on "standard forms" in InnoVia. Click on "2005 MLS fine system-rev07-04.pdf" for a complete list of MLS violations and fines associated with them. For the latest version of the MLS Rules and Regulations, click on "2007 MLS Rules.pdf." These rules and regulations have been submitted and reviewed by NAR and are in full compliance with National Association policy.

MINOR VIOLATIONS - $25

When one of the violations listed below is alleged, the SCAOR staff will send a Listing Complaint & Fine Notification by fax to the attention of the Participant (and verified by phone to the Participant). The Participant must have the error corrected within 48 hours of verification.

Depending on the information to be corrected, the SCAOR staff may make the required changes.

Violations include:

  1. Failure to enter a listing in the correct area, section, town as identified in the system.
  2. Failure to report the correct sale price on a closed listing.
  3. Failure to report the correct Selling Office and Selling Agent on the closed listing.
  4. Failure to correctly report all required fields on the Property Data Form.

ETHICALLY SPEAKING...

Article 16
REALTORS® shall not engage in any practice or take any action inconsistent with exclusive representation or exclusive brokerage relationship agreements that other REALTORS® have with clients. (Amended 1/04)

Standard of Practice 16-19
Signs giving notice of property for sale, rent, lease, or exchange shall not be placed on property without consent of the seller/landlord. (Amended 1/93)

Standard of Practice 16-20
REALTORS®, prior to or after terminating their relationship with their current firm, shall not induce clients of their current firm to cancel exclusive contractual agreements between the client and that firm. This does not preclude REALTORS® (principals) from establishing agreements with their Associated licensees governing assignability of exclusive agreements. (Adopted 1/98)
