Dear Members:

I am writing to provide you with an update from our General Members' Meeting which was held last Friday, November 2, 2007 at the Cheer Center.


First, allow me to express my thanks to those members who attended and brought forth a healthy discussion.

Second, I hope more of you will join us for the discussion and ultimate vote on Thursday, January 10, 2008 at Cheer Center. We will break bread for another delicious breakfast together!

A quorum was not declared last week since we had 128 members of the 140 required to conduct official business of the Sussex County Association of REALTORS®. What does this mean? We get to do it all again! We have consulted with our attorney, The National Association of REALTORS®, and conclude the easiest and most prudent way to proceed is to "do over" our attempt to conduct important business. For those interested, we have notes from the Assembly to inform you of the discussions that occurred.

This correspondence is the first of many you will receive in the next few weeks. You will be able to visit our website to view the proposed building plans and other concepts that have been introduced. Equally important, the By-Laws Committee and the Board have revised the proposed changes to our By-Laws and reduce the quorum required for a meeting from 10% to 5% of our general membership. As required by our by-laws, this is being noticed to members for more than the minimum 30 day requirement.

Any information you should need to make an informed decision and vote on that decision will be available for your review. As always, our SCAOR staff as well as your Board of Directors are available to answer your questions or listen to your concerns.

You have a voice, you have a vote, and I encourage you to participate in the process. I hope to see you at 9 am on Thursday, January 10, 2008.

NOVEMBER IS REALTOR® DESIGNATION AWARENESS MONTH

During this month, the NATIONAL ASSOCIATION OF REALTORS® encourages members to start, complete, or continue an official NAR designation or certification program.

 

SCAOR will hold its 2008 Officer Installation at the Lewes Yacht Club at Noon on December 11th. Registration information will be available next week. You must pre-register to attend; there are no walk-ins allowed. We look forward to seeing you there as we honor our outgoing and incoming officers.

CHANGES AT THE DIVISION OF PROFESSIONAL REGULATION

A new team-oriented administrative unit structure went into effect on November 1, 2007. Three service teams, an information center team, and the existing operations support team make up the restructured administrative unit. Each service team will consist of an executive director, a team leader and three staff members assigned to credentialing, licensee and board liaison services. In addition to the three service teams, a new information center team will increase responsiveness by responding to incoming phone and email inquiries.

ETHICALLY SPEAKING...

Article 17
In the event of contractual disputes or specific non-contractual disputes as defined in Standard of Practice 17-4 between REALTORS® (principals) Associated with different firms, arising out of their relationship as REALTORS®, the REALTORS® shall submit the dispute to arbitration in accordance with the regulations of their Board or Boards rather than litigate the matter.

In the event clients of REALTORS® wish to arbitrate contractual disputes arising out of real estate transactions, REALTORS® shall arbitrate those disputes in accordance with the regulations of their Board, provided the clients agree to be bound by the decision.

The obligation to participate in arbitration contemplated by this Article includes the obligation of REALTORS® (principals) to cause their firms to arbitrate and be bound by any award. (Amended 1/01)

Standard of Practice 17-4
Specific non-contractual disputes that are subject to arbitration pursuant to Article 17 are:

  1. Where a buyer or tenant representative is compensated by the buyer or tenant and, as a result, the listing broker reduces the commission owed by the seller or landlord and, subsequent to such actions, another cooperating broker claims to be the procuring cause of sale or lease. In such cases the complainant may name the first cooperating broker as respondent and arbitration may proceed without the listing broker being named as a respondent. Alternatively, if the complaint is brought against the listing broker, the listing broker may name the first cooperating broker as a third-party respondent. In either instance the decision of the hearing panel as to procuring cause shall be conclusive with respect to all current or subsequent claims of the parties for compensation arising out of the underlying cooperative transaction. (Adopted 1/97)

  2. Where two or more listing brokers claim entitlement to compensation pursuant to open listings with a seller or landlord who agrees to participate in arbitration (or who requests arbitration) and who agrees to be bound by the decision. In cases where one of the listing brokers has been compensated by the seller or landlord, the other listing broker, as complainant, may name the first listing broker as respondent and arbitration may proceed between the brokers. (Adopted 1/97)

  3. Where a buyer or tenant representative is compensated by the seller or landlord, and not by the listing broker, and the listing broker, as a result, reduces the commission owed by the seller or landlord and, subsequent to such actions, claims to be the procuring cause of sale or lease. In such cases arbitration shall be between the listing broker and the buyer or tenant representative and the amount in dispute is limited to the amount of the reduction of commission to which the listing broker agreed.
