THE RESULTS ARE IN:
MEMBERS SUPPORT EXPANSION!
Yesterday, January 10, 2008, over 280 members attended the General Membership Meeting held at the Cheer Center in Georgetown. SCAOR membership overwhelmingly voted in favor of the proposed capital expenditure for the addition, construction, and remodeling of existing SCAOR offices at Park Avenue. Additionally, SCAOR members voted to table the discussion on the proposed amendments to the SCAOR by-laws until the
by-laws Committee completes and recommends additional modifications. Thank you to all for your participation and comments during our meeting.

Public Awareness
Bill Lucks, President of SCAOR, announced the continuation of a Presidential Advisory Group on Public Awareness for 2008. Rob Harman, Past President; Sandy Hughes; and Nick Carter will join the 2007 PAG on Public Awareness to complete a comprehensive plan for REALTORS®.

The SCAOR Education Committee has voted to increase the price of education classes. In January and February, SCAOR members will pay $40.00 per class; non-SCAOR REALTORS®, $45; and non-members/non-REALTORS®, $50.00.

In March, prices will increase $5.00, so sign up now for January and February classes, and SAVE!

ALL CLASSES WILL BE HELD AT THE SCAOR OFFICE UNLESS OTHERWISE NOTED.
Registration will not be taken over the phone. No credits will be issued to late arrivals.

I am pleased to announce the 2008 Public Awareness Campaign. This year's campaign aims to give consumers the facts about the long-term value of real estate and current market conditions to balance the sometimes incomplete and sensational information presented in the national media.

The campaign launches nationally on January 14. The TV and radio ads will air more than 10,000 times on national TV and radio outlets from January through November, continuing the campaign's on-air presence for 11 months of the year.

In addition to the advertising placed by NAR and various local and state REALTOR® associations, the campaign includes Web banners, presentation materials, and other resources that you can use to enhance your business.

Delaware's 2008 Low Income Housing Tax Credit Qualified Allocation Plan (QAP).
Delaware State Housing Authority (DSHA) is in the process of finalizing the State of Delaware's 2008 Low Income Housing Tax Credit Qualified Allocation Plan (QAP).

A public hearing will be held to discuss the proposed QAP, as follows:

Oral and written comments will be accepted until that time.

After considering the comments received, DSHA will recommend the final QAP to the Governor for approval. Once approved, the QAP will be available to the public on the DSHA Website: www.destatehousing.com

ETHICALLY SPEAKING...

Below is a case interpretation related to Article 4. Please read the complaint and make a judgment on how the Professional Standards Panel should rule. The Hearing Panel's decision will be published in next week's newsletter.

Case #4-4: Responsibility for Subordinates
(Revised Case #13-6 May, 1988. Transferred to Article 4 November, 1994. Revised November, 2001.)

REALTOR-ASSOCIATE® B, a sales associate in REALTOR® A's office, exclusively listed a suburban house and subsequently convinced the seller to accept $20,000 less than the listed price. Several weeks after the transfer of title, the seller filed a written complaint with the Board, charging REALTOR-ASSOCIATE® B with a violation of Article 4 in that REALTOR-ASSOCIATE® B had sold the property to his mother without disclosing this relationship to his client, the seller, and that REALTOR-ASSOCIATE® B got the price reduced for his mother's benefit.

The complaint was reviewed by the Grievance Committee which, with the complainant's concurrence, named REALTOR® A as an additional respondent.

At the hearing, REALTOR-ASSOCIATE® B stated that he saw nothing wrong in selling the property to his mother and that the seller would have accepted the contract at the reduced price, even if the buyer had not been REALTOR-ASSOCIATE® B's mother. REALTOR® A stated that REALTOR-ASSOCIATE® B was an independent contractor licensed with him. REALTOR® A acknowledged that he was accountable under the Code for the actions of other REALTORS® and REALTOR-ASSOCIATES® associated with him but shared with the panel information on his firm's orientation program. He noted that he required each licensee joining his firm to complete board-sponsored Code training. In addition, he required everyone in his firm to read Professionalism in Real Estate Practice, and produced a form signed by REALTOR-ASSOCIATE® B stating that he had carefully read and understood his personal obligation under the Code of Ethics.
