Excerpts from a recent conversation:
Ruth said, "Bill, you know it's tradition for the SCAOR President to Participate in the Ocean Jump." Bill responded, "I am not jumping in the ocean. Forget it. But, I will enjoy the delicious hors d'oeuvres, a fabulous view of the ocean, and chatting with my colleagues."

Ruth replied, "Now, Bill we can do better than that. After all, it is in Rehoboth on our turf." so... Bill will make the Ocean Jump if 75 of our members will support the cause by signing up and cheering him into the freezing water. Game on!!!

You can forget the cold water, stay warm with us as we watch and cheer others to Jump. Help greet special NAR guests and others from around Delaware. Don't be left out in the cold... make it an RPAC Donation and a date!

What a bargain!!

If your office has spare SentriLock lockboxes, and you have more than 5 not in use, please email or call TracyLee at the Association. We have a severe shortage of lockboxes due to the high number of active listings, and need every available lockbox to be in use. Also, if you have broken lockboxes, they also need to be turned in to the SCAOR office, so they may be sent for repair.

Call TracyLee at (302) 855-2300 or tracylee@scaor.com.

Rental Matters
Welcome once again to Rental Matters, an informative article concerning rental issues.

Our next Rental Affairs Committee meeting will be held this coming Wednesday, March 12th at the Coldwell Banker office in Rehoboth. Come on out and join us. We welcome new members and would love to hear what you have to say.

On February 13, 2008 the Rental Affairs Committee held its second meeting of the New Year. Mr. Bruce Marine, Account Executive for The Insurance Market, was our guest speaker to update the committee on the New Worker's Compensation Insurance Law. Did you know that effective January 17, 2007, Governor Ruth Ann Minner signed Senate Bill 1 into law pertaining to contractors carrying liability and workers' compensation? The important component of the reform is the requirement that all independent contractors (even those who do not have employees) are covered under an insurance plan. All contractors, subcontractors and independent contractors are required to obtain workers' compensation insurance coverage immediately, if they have not already done so. As many as 4 individuals who are members of a limited liability company may be exempted from this chapter. Sole proprietors and partners are not included within this chapter, but such sole proprietor or partner may elect coverage. Bruce encouraged all Real Estate offices paying their cleaning crews to make them aware of the new law and insist they have insurance. He also recommended that contractors buy a bond at the cost of approximately $112 per year. Cleaning contractors being paid by owners are exempt from the new law. In conclusion, if a contractor receives a 1099 they must have workers' compensation. The Department of Labor has issued a press release to alert those affected by this specific provision of the law. The press release can be accessed by Clicking Here.

On another note, SAVE THE DATE! The annual Rental Spring Celebration (our beginning of season party) will be held on April 23, 2008. Soooooooooo, grab your teammates and plan to join us there. The time and location will be disclosed shortly.

Before I close just a few words of encouragement. Now that the heavy booking season is upon us and the non-stop phones calls are raining down on you, Let Your Smile Be Your Umbrella!

Chrissy Hitchens
Rental Affairs Committee
Chairman

Many lessons must be learned just from the time you earn your real estate license to the time you celebrate your first handful of sales. To achieve success, we continue to be students throughout our careers -- of our industry, the economy, regulations and changing homebuyer trends. So we changed "Rookie Corner" to a more appropriate name to address our entire audience. First, thank you to ALL of our readers -- rookies and the 10-year plus and everyone in between! Second, we encourage you to submit questions and topics YOU would like to see covered by "Ronnie, REALTOR®."

If you have any suggestions for future articles you would like to see, click on the link below.

Have a Question for Ronnie? Question

This week's topic is the CIS Statement - Are YOU Breaking the Law?.

It has come to my attention that agents are still presenting the CIS Statement at the time of the signing of the contract, and not at the times required by law.

ETHICALLY SPEAKING...

Below is a second case interpretation related to Article 6, which may be of special interest since it involves when a REALTOR® is acting as a property manager.

Case #6-2: Manager's Use of Client's Property for Vending Machines

REALTOR® A managed Client B's large apartment building, and made an arrangement under which coin-operated vending machines were placed in the basement of the building.

Six months after the machines were installed, Client B noticed them and raised a question as to the propriety of REALTOR® A's action in installing them, and deriving revenue from them, without Client B's knowledge and consent. REALTOR® A's response was that he had considered the machines a service to the tenants which in no way affected Client B's interests. He told Client B that he did derive a small amount of revenue from them, which had not been remitted to Client B because he felt that this revenue compensated him for his time and effort in arranging for installation of the machines and maintaining contact with the firm that operated them. He suggested that if Client B was unhappy he could seek a formal ruling by submitting the matter to the Professional Standards Committee of the Board of REALTORS®.

Accordingly, Client B did just that. At a hearing on the matter it was established that REALTOR® A had not consulted his client at the time he authorized installation of the machines; that revenue derived from operation of the machines had been retained by REALTOR® A; and that Client B had been furnished no information whatsoever in the matter until he observed the machines in his own periodic inspection of the building.

How do you think the Professional Standards Panel ruled?
