Licenses expired April 30, 2008. If you did not meet your continuing education requirements, you cannot sell real estate until you complete your education requirements. See this information from the Delaware Real Estate Commission website at www.dpr.delaware.gov.
How to Renew an Expired License
If you do not renew your license before the expiration date, your license will expire. It is illegal to practice while your license is expired.
You may renew a license for a period of sixty days after the expiration date by submitting a renewal application and paying a late fee. However, if the license has been expired more than 60 days, you must apply for reinstatement of the license. |

The Sussex County Association of REALTORS® will have a General Membership
meeting on June 19, 2008 at 8:30 am in the Cheer Center, Georgetown.
Breakfast will be provided. To ensure a seat and breakfast, please RSVP by
using the registration link.
All REALTOR® members will soon receive an additional meeting notice including notice of proposed amendments to the by-laws and the need to VOTE on the proposed amendments.

Below is a case interpretation related to Article 11 of the REALTOR® Code of Ethics.
Case #11-10: REALTOR's® Obligation to Disclose Present or Contemplated Interests
Client A, an owner, needed to sell a property. She approached REALTOR® B to list the property. They agreed to the terms of the listing and the property was listed.
An offer was made and was accepted by Client A. After the prospective purchaser completed the loan application, REALTOR® B was contacted to appraise the property. When the lender was preparing the closing statement, the lender became aware that the listing broker was also the appraiser and filed a complaint with the Board of REALTORS® alleging that REALTOR® B had failed to disclose in the appraisal that he had an interest in the property, specifically seeing that the sale closed. The complaint was referred by the Grievance Committee for hearing before a panel of the Board's Professional Standards Committee.
At the hearing, REALTOR® B protested that the lender was misreading Article 11, as interpreted by Standard of Practice 11-1, claiming that "any present or contemplated interest" referred only to an ownership interest. REALTOR® B concluded that the listing commission had been earned when a ready, willing, and able purchaser contracted to purchase the property and that the appraisal process was separate and distinct from the brokerage process.

Don't Let Improper Advertising Bring You Down
as You Work to Rev Up Your Business.

Beware:
It has come to our attention through several complaints that a number of our members are using Craig's list for the placement of real estate ads. We have also noted that a number of you are not following the Delaware Real Estate law in your advertising. We encourage you to make sure you are on solid ground.
Please follow the proper procedures so you will avoid any problems.
Some Important Comments on Advertising:
- Any licensee who advertises in newspapers, the Internet, or any other media, real property personally owned or real property in which the licensee has any ownership interest must include in the advertisement that he or she is the owner of said property, and that he or she is a real estate licensee.
- Any licensee who advertises on signs, newspapers, the Internet, or any other media, any real property for sale, lease, exchange, or transfer that is listed with a broker must include in legible print in the advertisement the complete business name that has been registered with the Commission, and office phone number registered by the broker of record with the Commission for that office location.
- Nothing contained herein shall preclude the listing of additional phone numbers. All such advertising shall also contain language or abbreviations that clearly identify each phone number listed, examples include, but are not limited to: "Office", "Home", "Res.", "Car", "Cell".

The duties imposed by the Code of Ethics encompass all real estate related activities and transactions whether conducted in person, electronically, or through any other means. Members are encouraged to revisit Article 12 with particular attention to 12-8, 12-9, 12-10, and 12-11 and Article 15 with particular attention to 15-2

Misrepresentation is by far the lawsuit that brokers face the most. Misrepresentation is the misstating of some material feature of the property. Another area of lawsuits is Failure to Disclose. Failure to Disclose is just flat out not revealing some important feature of the property.
