SCAOR is recruiting members interested in leadership. The Nominating Committee seeks any interested members to apply for leadership roles in 2009.

  • 1st Vice President (job description)- One year term, a position of growth towards the Presidency, not an automatic renewal position
  • 2nd Vice President (job description) - One year term, a position of growth towards the Presidency, not an automatic renewal position
  • Treasurer (job description) - One year term, responsible for the finances of SCAOR and chairperson of the Finance Committee
  • 1 Year Director - A one year term
  • 2 Year Director - A two year term
  • 3 Year Director - A three year term

STATEWIDE FORMS UPDATE
The new Statewide Sales Agreements for Residential Sales and for Unimproved Land are now available at www.scaorstore.com Members Only. They are conveniently available once logged in.

The Agreement of Sale for Delaware Unimproved Land
is a new Form, effective as of July 1, 2008.

There is also a revised Agreement of Sale for Delaware Residential Property. The revised Residential Agreement of Sale (with a July 1 date in the footer) should be used starting July 15.

Let me start out by saying that, financially, times are tough right now - you know it, I know it and all of us here at the Sussex County Association of REALTORS® know it. I'm not going to try and convince you otherwise. But you know the saying about real estate being about location, location, location. Well, we have both a great location and a great tax rate. People still want to move here - and there's a lot to be positive about.

Holabreaking ground

The Education committee is offering Spanish for REALTORS® in the fall. You must attend all 7 courses (2 hours each) to obtain your 15 credit continuing education certificate. Class dates are September 8th through October 20th on Mondays, 10 a.m. - Noon. Course cost is only $105! Sign up online for this excellent class to broaden your skills as a REALTOR® in a diverse market. If you are unable to attend all seven classes, but would still like to attend class, you will pay $105 but will not receive course credit.

ETHICALLY SPEAKING...

Below is a case interpretation related to Article 14. Please read the complaint and make a judgment on how the Professional Standards Panel should rule. The Hearing Panel's decision will be published in next week's At a Glance.

Case #14-3: Submission of Pertinent Facts

Buyer A filed a complaint against REALTOR® B, the listing broker, involving a property purchased earlier by Buyer A.

REALTOR® B was notified of the complaint, directed to be present at a hearing, and requested to present to a Hearing Panel of the Board's Professional Standards Committee all pertinent facts relating to the transaction. REALTOR® B's response was a statement that he would refuse to submit any information in the matter to a Hearing Panel and would not attend the scheduled hearing, on the grounds that the complaint itself was not justified.

Explaining his position, REALTOR® B stated that his participation in the transaction was exclusively as the agent of the seller; that he had not been representing the buyer; and hence, could not be subject to a complaint by the buyer for simply transmitting information on behalf of the seller.

All of his statements concerning the property, REALTOR® B said, were based on information supplied to him by his client, the seller. Any error in this information, he contended, might well provide the basis for a lawsuit between the buyer and seller. As the agent of the seller, he felt that he was not answerable to the buyer for having done no more than transmit information provided to him by the seller.

It's November 19 this year and we will get to see the Tony Award and Laurence Olivier Award winner Patti LuPone in "Gypsy". Tickets are $135 which includes orchestra seats, transportation, breakfast pastries, snacks and beverages. The bus leaves the SCAOR office at 6:30 a.m. sharp for an approximate 11 a.m. arrival in NYC. You will have time for independent sight-seeing and lunch before the show begins at 2:00 p.m.
