REALTOR® Safety Week . . . A message from NAR President Dick Gaylord:

"Every week REALTORS® put themselves at risk by welcoming complete strangers into a home or getting into a car along with someone they just met. These everyday occurrences have the potential to turn into a personal nightmare, if our members don't understand and follow the basic tenets of personal, professional, and client safety.

On September 14 - 20, 2008 NAR will mark the sixth annual REALTOR® Safety Week. Please use resources available at www.REALTOR.org/Safety.

Working "All Together", we can protect our members from risks and ensure that all REALTORS® have the opportunity to succeed well into our second century."

REALTOR® SAFETY TIPS:

  1. Always make sure someone knows where you are going and who you plan to meet there - including the client's name and phone number.
  2. Always schedule first meetings with new clients in the office, verify their identify, and introduce them to a colleague.
  3. Always keep a charged mobile phone with you, whether you're in the office, on the road, or at property showings.

HURRICANE THREATS DIDN'T STOP THE JUNGLE INVASION

REALTORS® are hearty souls, and turned out in flocks for the RPAC Jungle Jim's duck race last Friday. Despite threatening skies, the supporters of RPAC and their families came and enjoyed pizza, margaritas, steel drum band music and more while flocking under semi-stormy skies. 190 people flocked to this event, and raised $6,100 for RPAC, your political action committee protecting REALTOR® interests in Delaware and Washington, D.C.

A tip of the wing to Connie Covey of Callaway, Farnell and Moore, and Dave and Jeff Tidwell, of Jack Lingo, for bringing the most family members to the river. They tied at ten family members each!

  • Top donor office was RE/MAX Rehoboth Beach
  • Winner in the office duck race was Long and Foster Rehoboth Beach
  • Most dapper dressed duck was Sergovic and Carmean's Ben Franklin quack alike duck
  • 100% office was RE/MAX Eastern Shore
  • Most individual ducks sold - Steve Alexander, President-Elect 2009

Changes to MLS Rules and new MLS Waiver Form
The MLS Committee, with the approval of the SCAOR Board of Directors, has revised the existing form used to notify the MLS of the seller's refusal for the listing to be disseminated through SCAOR MLS.

The MLS rules have required a "listing waiver" be completed and sent to the Association office within 48 hours of the listing date along with a copy of the listing. The revised form is found on Innovia as SCAOR MLS Listing Waiver.

Please ensure you promptly submit the forms to our office in a timely manner. Violations of this rule have a significant fine of $1,000.00. It is to everyone's benefit to have the listing waivers on file should a concern arise.

Also available on Innovia are newly revised MLS rules that include Section 1.18: Required Attachments and Section 17 for reciprocal key card usage.

We appreciate your attention and use of the new forms. Please do not hesitate to contact me with your concerns or questions.

Sincerely,

Ruth Briggs King
Executive Vice President.

SCAOR PHONES WILL BE DOWN FOR INSTALLATION

The new phone system will be installed at SCAOR on Thursday, September 18. Please be understanding as we will have no phone service from approximately Noon to 4 p.m. If you have a need to contact SCAOR on that day, email info@scaor.com and we will reply via email. Thank you for your patience as we move forward on our construction.

DREC UPDATE

On September 11 many SCAOR members travelled to Woodside, Delaware for DREC's Annual Seminar. Three current issues were topics of discussion:

  • New Sellers Disclosure, Andy Taylor
  • Short Sales, Don Ash
  • Statewide Sales Agreement, Bill Ward

James Collins, Director of the Division of Professional Regulations provided an update on changes in the Division as well as new procedures for licensing of real estate salespersons. The Division will now administratively issue licenses to sales agents whose applications are complete and meet requirements. This means applicants do not have to wait for a DREC meeting to receive licensee status. Applicants will be able to check online and see the status of their application.

Christopher Whitfield, Chair of DREC, shared concern about licensees who did not complete the education requirements by April 30, 2008. He stated that 15% of licensees were audited and 135 of those licensees did not respond to DREC. Several "Show Cause" hearings will be conducted in October. This is a serious concern and will be addressed as such by the Commission.

SCAOR members are reminded to use the new Sellers Disclosure that went into effect on September 1, 2008. The new Sellers Disclosure is not retroactive to listings existing before September 1, 2008.

This week's topic is about RESPA.

The Real Estate Settlement Procedures Act (RESPA) is a consumer disclosure and anti-kickback statute designed to inform consumers of their settlement costs and to prohibit kickbacks that can increase the cost of obtaining a mortgage.

Take the quiz to find out how well you know about this important issue to stay on the right side of the law.

POLICE ICON

The police icon was introduced two years ago as a tool for REALTORS® to communicate with one another about MLS listing content and provided an anonymous entry. As you may recall, we have posted several comments about the content and tone of messages used in the police icon response.

As of October 1, 2008, the police icon will no longer be undercover, but will include the identity of the sender. So, please continue to assist in identifying your concerns with a listing; however, your fellow REALTORS® will know the source and be encouraged to communicate directly. For serious alleged violations of the MLS, please contact the SCAOR office to file a formal complaint.
