MLS CHANGES EFFECTIVE NOW

Dear Broker and MLS Participant:

This letter contains important information regarding the Sussex County Association of REALTORS® MLS and changes to the rules as well as administrative procedures.

First, Participants are reminded of their agreement to place all listings in the SCAOR MLS if the property is located in the Association's jurisdiction. This includes commercial properties as well as the others noted in Property Type Descriptions.

The MLS Committee and Board of Directors has also approved several listing procedure and significant Fee Waiver rules changes, and MLS system enhancements that are in effect as of Wednesday, October 1, 2008.

PRESIDENT BUSH SIGNS $700 BILLION RESCUE BILL TODAY

In efforts to push Congress forward on approving a financial recovery plan, NAR deployed a "Call to Action" to all members on Tuesday. The late night e-mail from NAR President Dick Gaylord spelled out why the Emergency Economic Stability Act is so important to real estate, and asked members to contact their representatives to voice support.

"REALTORS® know better than anyone else how important housing is to our local and national economies. Like it or not, the housing market can't rebound until we resolve the problems in the financial markets. Now is the time to act before they move beyond repair," Gaylord said in the e-mail.

Thank you to our members who took a few moments to respond to the Call to Action. The House of Representatives did pass the Emergency Economic Stimulus Act (EESA) today, October 3, and the President signed the Act into law within minutes after.

POLICE ICON  

The police icon was introduced two years ago as a tool for REALTORS® to communicate with one another about MLS listing content and provided an anonymous entry. As you may recall, we have posted several comments about the content and tone of messages used in the police icon response.

As of October 1, 2008, the police icon will no longer be undercover, but will include the identity of the sender. So, please continue to assist in identifying your concerns with a listing; however, your fellow REALTORS® will know the source and be encouraged to communicate directly. For serious alleged violations of the MLS, please contact the SCAOR office to file a formal complaint.

ETHICALLY SPEAKING... Our Duties to Clients and Customers

How do you think the Professional Standards Panel ruled in last week's Case Study? Below is the Hearing Panel's decision.

Case #1-26: Subordination of Client's Interests to REALTORS®'s Personal Gain

Upon questioning by Dr. Z's attorney, REALTOR® B acknowledged that he knew about but had not shown the house with the indoor pool to Dr. Z. He conceded that a pool that could be used year round was better suited to the family's needs than one that could be used only four months each year. He also admitted his failure to tell Dr. Z about the house with the indoor pool had at least in part been motivated by the bonus offered by his firm. "But," he argued, "aside from the indoor pool, that house was no different than the one Dr. Z bought."

The Hearing Panel concluded that REALTOR® B had been fully aware that one of Dr. Z's prime concerns was his wife's ongoing physical conditioning needs and REALTOR® B's decision to show Dr. Z only properties listed with XYZ and to not tell him about the home with the indoor pool had been motivated by the possibility of earning an in-house bonus. The Hearing Panel determined that REALTOR® B had placed his interests ahead of those of his client and had violated Article 1.
