2009 SCAOR COMMITTEE MEMBERSHIP |

Another year is almost over and it is time to form the 2009 committees. If you are interested in becoming a member of a committee next year, please indicate which committee you are interested in by checking the appropriate committee box(es) on the PDF, Word or online application, completing the information about yourself, and returning your form to SCAOR by November 17.
Each committee description will be included over the next few issues of At a Glance. If you have questions about a specific committee please call the SCAOR office at (302) 855-2300. We will try to accommodate as many requests as possible; however, some committees are limited in size. Volunteer names will be submitted to the Board of Directors for approval.
Grievance Committee
Purpose: To review ethics complaints and requests to arbitrate, to determine if there is a possible violation in the Code of Ethics or the matter is an arbitrable matter.
Goal: Enforce the Code of Ethics & promote professional conduct.
Meetings: As needed when complaints are received.
Special Requirements: Each member that serves on this committee must complete a mandatory Professional Standards Training Course held the first part of 2009. Two vacancies for 2009, each a 3 year commitment.
Multiple Listing Service Committee
Purpose: To monitor and recommend to the Board of Directors the ongoing services to the general membership as it relates to the computerized services of the real estate market in Sussex County.
Goal: Continue to monitor issues that affect the MLS books, online computer service and forms.
Meetings: Meets monthly on the 2nd Tuesday at 9:00 am at SCAOR.
Professional Standards Committee
Purpose: To provide the framework for the membership to hold itself accountable to NAR Code of Ethics and SCAOR Bylaws. To develop an ongoing program to explain the Code of Ethics to members and the public at large for the purpose of professional enlightenment.
Goal: Enforcement of the Code of Ethics.
Meetings: After the training session the committee will meet as hearings are scheduled.
Special Requirements: A training session is mandatory in January for all members. If you do not attend the training session, you will be unable to serve on this committee. 3 year terms.
The Grievance, MLS, and Professional Standards committees have specific member requirements, and there are a limited number of openings available.
We appreciate your interest but may not be able to accommodate all committee requests. |

POLICE ICON
The police icon was introduced two years ago as a tool for REALTORS® to communicate with one another about MLS listing content and provided an anonymous entry. As you may recall, we have posted several comments about the content and tone of messages used in the police icon response.
As of October 1, 2008, the police icon is no longer undercover, and will include the identity of the sender. So, please continue to assist in identifying your concerns with a listing; however, your fellow REALTORS® will know the source and be encouraged to communicate directly. For serious alleged violations of the MLS, please contact the SCAOR office to file a formal complaint.

ETHICALLY SPEAKING... Our Duties to Clients and Customers
Case #1-18: REALTOR® Not Responsible for Legal Advice
Client A listed a commercial property with REALTOR ® B who sold it. Following the sale, Client A learned that his total tax position would have been more favorable if he had disposed of the property in a trade. He complained to the Board of REALTORS ® against REALTOR ® B stating that in connection with his listing of the property he had discussed his total tax position with REALTOR ® B, and that REALTOR ® B, in spite of his obligation under Article 1 of the Code of Ethics to "be informed regarding laws" had failed to advise him that a trade would be more to his advantage than a sale.
At the hearing, REALTOR® B defended his actions by stating that it was true that Client A had briefly outlined his total tax situation at the time he listed the property for sale. REALTOR® B advised that he told Client A that sale of the listed property might result in unfavorable tax consequences and suggested that Client A consult an attorney. The client had not taken his advice.
After several weeks of advertising and showing the property, in the absence of a change of instructions from the client, the property was sold in accordance with the terms of the listing contract.

IMPORTANT CHANGE: Justice of the Peace Court Locations for Summary Possession
Previously, when more than one Justice of the Peace Court location heard civil cases within a county, the law required that landlord/tenant actions for summary possession be filed in the court closest to the property in question. This area was commonly referred to as the court location's territorial jurisdiction. Senate Bill 216 (SB 216) and Justice of the Peace (JP) Court Rule 3 have replaced the former territorial jurisdictions with district boundaries which more properly define and utilize JP locations. Now, in Sussex County, you will file summary possessions at JP Court 17 in Georgetown.
