Committee Volunteer Deadline: Nov. 17

                                      

Interested in becoming a member of a 2009 committee? Now is the time, and SCAOR has several committees to meet our membership's interests and needs to choose from. Please indicate which committee(s) you are interested in by checking the appropriate committee box(es) on the PDF, Word or online application, completing the information about yourself, and returning your form to SCAOR by November 17.

Which Committees? See full committee descriptions, when they meet, who their 2009 Committee Chair is, and any special membership requirements at www.scaorstore.com/about/committees.htm.

Questions about a specific committee? Please call the SCAOR office at (302) 855-2300. We will try to accommodate as many requests as possible; however, some committees are limited in size. Volunteer names will be submitted to the Board of Directors for approval.


Education Committee
Purpose: To maintain the ongoing continuing education at the Association.

Government Affairs / RPAC Committee
Purpose: To serve as a liaison for the membership on all political issues facing the real estate community.

Grievance Committee
Purpose: To review ethics complaints and requests to arbitrate, to determine if there is a possible violation in the Code of Ethics or the matter is an arbitrable matter.

Housing Opportunities Partnership (HOP)
Purpose: Promote Fair Housing and Diversity awareness to our members, promote community outreach, and develop programs supporting NAR Diversity Initiatives.

Multiple Listing Service Committee
Purpose: To monitor and recommend to the Board of Directors the ongoing services to the general membership as it relates to the computerized services of the real estate market in Sussex County.

Professional Standards Committee
Purpose: To provide the framework for the membership to hold itself accountable to NAR Code of Ethics and SCAOR Bylaws. To develop an ongoing program to explain the Code of Ethics to members and the public at large for the purpose of professional enlightenment.

Rental Affairs Committee
Purpose: REALTORS® whose primary interests are the rental of property. To promote and share the concerns of the large rental market in Sussex County

Risk Reduction / Bylaws Committee
Purpose: Monitor issues that will affect broker/agents on a liability basis as well as monitoring and updating SCAOR bylaws.

Rookies Committee
Purpose: Educating and helping new agents (under 3 years) in their upcoming real estate career.

Are you in the know on the latest information regarding the SCAOR MLS and changes to your MLS rules & procedures?

First, Participants are reminded they are under agreement to place all listings in the SCAOR MLS if the property is located in the Association's jurisdiction. This includes commercial properties and all types noted in Property Type Descriptions.

The MLS Committee and Board of Directors has also approved several listing procedure changes, significant Fee Waiver rules changes, and MLS system enhancements.

ETHICALLY SPEAKING... Our Duties to Clients and Customers

Case #2-19: Deceptive Information in MLS Compilations

REALTOR® R searched the MLS compilation of current listings on behalf of his client, Dr. Z, who had recently completed his residency and was returning home to take a position on the staff of the community hospital. REALTOR® R's search returned several listings that satisfied Dr. Z's requirements, including a two-story residence listed with REALTOR® B that showed, in the "Remarks" section of the property data form "Pay your mortgage with rent from the apartment upstairs."

REALTOR® R attached the listings he had identified to an e-mail message that he sent to Dr. Z. A day later, REALTOR® R received a call from Dr. Z who told him there was something about REALTOR® B's listing that struck him as odd. "That house is in the neighborhood I grew up in," said Dr. Z. "I also remember our neighbors having a problem with the Building Department when they added a kitchen on the second floor so their grandmother could have her own apartment."

REALTOR® R assured Dr. Z that he would make the necessary inquiries and get back to him promptly. His call to the Building Department confirmed Dr. Z's suspicion that the home was zoned single family.

Feeling embarrassed and misled by REALTOR® B's apparent misrepresentation, REALTOR® R filed a complaint with the local association of REALTORS® alleging misrepresentation on the part of REALTOR® B for publishing inaccurate information in the MLS.

At the hearing convened to consider REALTOR® R's complaint, REALTOR® B acknowledged the seller had told him that the conversion had been made to code but without the necessary permits, and the apartment had never been rented. "I assumed the new owners could get a variance from the Building Department," he said.

Update on the Pollution Control Strategy . . . now it's the law!

On Wednesday, October 15th Governor Ruth Ann Minner and DNREC Secretary John Hughes signed into law the latest DNREC regulatory rulings for the Inland Bay Watershed and the long delayed Pollution Control Strategy.

These new regulations will impact both agriculture and Real Estate development. The primary concern for SCAOR members obviously will be the impact on Real Estate transfers.

Among other things, this new law legislates that ALL existing septic systems in Sussex County will soon be required to have a mandatory inspection. In the first year, inspections will be for systems closest to the bay and tributaries. Then for the next two years, the systems increasingly farther from the bay and tributaries will be inspected. Cesspools will no longer be acceptable, even if previously deemed functional.

All Real Estate transactions that have existing septic systems in place will require the seller to produce documentation of recent / current system maintenance and adequacy.

Additionally, buffers along primary and secondary water features (as defined in the regulations) must be established as land is developed. Buffers are NOT required on existing developed lands or lands being used for agriculture.

Once we have full and complete documentation of all of the new regulations, and their implementation dates we can further advise our SCAOR members.

 
Watchdog

IMPORTANT CHANGE: Justice of the Peace Court Locations for Summary Possession

Previously, when more than one Justice of the Peace Court location heard civil cases within a county, the law required that landlord/tenant actions for summary possession be filed in the court closest to the property in question. This area was commonly referred to as the court location's territorial jurisdiction. Senate Bill 216 (SB 216) and Justice of the Peace (JP) Court Rule 3 have replaced the former territorial jurisdictions with district boundaries which more properly define and utilize JP locations. Now, in Sussex County, you will file summary possessions at JP Court 17 in Georgetown.
