Delaware Uniform Common Interest Ownership Act (DUCIOA) — The new law is creating some confusion for REALTORS®, attorneys, and communities. We anticipate amendments to the law and we anticipate you to have questions regarding the changes. As we learn more, we will share the information with you. The required form is the Resale Certification which is a requirement of the seller. The form has been posted on www.scaor.com in the members only section as "Resale Certification Form."

Dear REALTORS®/Appraisers,
The National Association of REALTORS® requires that each member complete the NAR Ethics course once every four year period. This begins at the time of each member's orientation to their respective, primary board of affiliation.
This course conforms and is uniform to all REALTOR® organizations and is applicable to all members on a National, State, and Local scale.
It should not be confused with professional licensing standards. Many licensing guidelines require an Ethics course involving the real estate and appraisal professions. However the NAR Ethics course is not interchangeable with another provider's Ethics course. The NAR Ethics may be utilized as an elective towards licensure education requirements.
We have received several requests for substitution of Ethics courses offered by various providers and organizations. Many organizations are approved for issuance of Continuing Education. If the course is approved by the state licensing authority in which the member is licensed, it may be accepted towards licensing requirements but not towards the NAR requirement.
Below you will find information regarding when and where the NAR Ethics course will be offered prior to the end of the year 2008.

www.thescaorstore.com, Offer Date December 19, 2008 at the Cheer Center in Georgetown. Cost $40.00 to $45.00.

MEMBER ALERT: Government Affairs Chair, Camilla Conlon and Vice Chair, Sue Bramhall encourage you to take a few moments and review proposed ordinances that will impact property rights in Sussex County. We need to you call Council Members as well as attend the meetings to let your voice be heard. This Tuesday, Dec. 16 the Council will consider "an ordinance to amend chapters 99 and 115 of the Code of Sussex County to define open space and to incorporate open space requirements into the application and approval process in all residential zoning districts and in residential planned communities and to clarify provisions relating to resubdivision, permitted uses, bonds, site plans, and other approval criteria."
Buried in the midst of this plan is the issue of buffers and barriers, tidal wetlands, etc. SCAOR was present and made comments at the introduction of the Ordinance, but more voices are needed. You may visit the county website or click here to read in its entirety.
As the County Council changes in January 2009, we will need you to join the Committee on key issues. It will be a busy year!

On December 18, 2008 we will be introducing an updated home page for our MLS. We're pleased to announce the improvements and upgrades listed below:
Increased functionality and a customizable "dashboard" home screen.
New features will include:
- A customizable screen: make it look the way YOU want, use what you need and you can hide the rest. Drop and drag to any location in any order.
- Editable Calendar (with import/export capabilities to follow shortly)
- On the Association Level, staff will be able to upload special events, Continuing Ed classes, and other important deadlines.
- On the Broker level, staff will be able to disseminate information to agents and admins regarding functions within a company.
- On the Agent level, members will be able to keep track of appointments, birthdays, closings, meetings and any other important dates.

How do you think the Professional Standards Panel ruled in last week's Case Study? Below is the Hearing Panel's decision.
Case #4-1: Disclosure when Buying on Own Account
The panel concluded that since REALTOR ® B's own purchase was clearly understood by the client to be a purchase on his own account, and since the client's suspicions of duplicity were proven to be unfounded, REALTOR ® B had not violated Article 4 of the Code of Ethics.
