CIS Statement
It has come to my attention that agents are still presenting the CIS Statement at the time of the signing of the contract, and not at the times required by law. "Delaware law requires real estate sales persons and brokers to provide the CIS at the earlier of the first scheduled appointment or the first showing of a property. If your first contact is via fax or email, this CIS must be supplied with any other papers sent by electronic transmission. You must read and complete this CIS before you list your home for sale or go with a salesperson or broker to view homes to buy." I think it is important to look at the first three words of the above paragraph: Delaware law requires... It's the law, and if we fail to follow it as written, we are breaking the law and subject to reprimand. Take a look at the remainder of the paragraph: at the earlier of the first scheduled appointment or the first showing of a property. If your first contact is via fax or email, this CIS must be supplied with any other papers sent by electronic transmission. It doesn't say "when I feel comfortable enough with my client to ask him to sign this document" (an excuse that I have heard often). It also doesn't say "when you get all other real estate documents signed". I spoke with a Real Estate Commissioner the other day to get his thoughts on the subject. He made it perfectly clear that IT'S THE LAW and that we must follow it. If a complaint is brought by a consumer or REALTOR® against us for not following the law, we are subject to reprimand. My suggestion is to have the CIS form in your car, in your office's conference room, at your desk, and on your computer, so that no matter where, when, or how you're communicating with your client, you'll have a copy ready for signature. It certainly will enhance our professional image, and more importantly, it will keep us out of trouble.
